Convicted child killer Theodore Frank must face a second penalty trial that could lead to a death sentence, an Orange County Superior Court judge ruled. Judge John J. Ryan denied a motion to allow Frank, 51, convicted of molesting and murdering a 2-year-old Camarillo girl in 1978, to be sentenced to life imprisonment without possibility of parole. Instead, Frank must face a jury, which will decide for a second time whether he should live or die. Frank previously was sentenced to the gas chamber for the kidnap, torture, rape and murder of toddler Amy Sue Seitz in 1978, but the sentence was overturned by the state Supreme Court last year on grounds that his writings about molesting children were illegally seized from his home and used against him.
