The six-member State Athletic Commission split its vote on the appeal filed by Albert Davila on the decision to stop his North American Boxing Federation bantamweight championship fight against Frankie Duarte last month.
Because of the 3-3 vote, no determination was made, and Duarte will retain his title. A seventh member of the commission missed the Fresno meeting, making the deadlock possible.
The nationally televised 12-round bout at the Forum June 27 was stopped by referee Lou Filippo at 2:09 of the 10th round because Davila had a severe cut over his left eye.
Duarte, who apparently had butted Davila earlier in the fight, was awarded the victory, although Davila led on the scorecards of all three judges.
Mike Rupprecht, Davila’s attorney, said after the hearing that he plans to file a court appeal.
