The suspect in the shooting death of a 14-year-old girl and the wounding of another teen-ager in Oceanside was charged Friday with first-degree murder and attempted first-degree murder.
The district attorney is also charging Akeli Kelly with the special circumstance of lying in wait in the death of Michele Tate on Monday, making Kelly eligible for the death penalty if he is found guilty.
Deputy Dist. Atty. Greg Walden said complications in the case have delayed the release of a police report, but “when it comes out, it’ll be like a novel.”
Officer E. J. Luarca of the Oceanside Police Department said Friday that there were no new developments in the case.
Tate, a freshman at El Camino High School, was gunned down as she and three friends left a fast-food restaurant in eastern Oceanside shortly after 9 p.m. Monday. The bullet that killed Tate also wounded a pregnant 17-year-old companion.
Members of Kelly’s family, including his mother, his wife and an aunt attended the arraignment, but declined comment.
Kelly is being held without bail, pending a bail review Friday. A preliminary examination is scheduled for Nov. 7.
