SANTA ROSA — A Sonoma County judge has dismissed two molestation charges against a priest that dated back to 1977, saying the alleged offenses happened too long ago to pursue.
Prosecutors immediately vowed to appeal the decision by Superior Court Judge Frank Passalacqua.
The Rev. Don Kimball originally faced four molestation charges--two from 1977 and two from 1981. With the earlier two dismissed, he now faces a maximum sentence of six years in prison if convicted, said Chris Andrian, Kimball’s attorney.
Kimball, 56, has denied all charges.
